Day 243 - 02 May 96 - Page 23

MR. JUSTICE BELL: Have I got a copy of the article at the
moment? Give me the reference, if you can.

MS. STEEL: It is in Defendants' documents, tab 116, of the
original list, bundle IV, kingfisher blue IV, and it starts
four pages in behind some other press reports.

  MR. JUSTICE BELL: Thank you.

MS. STEEL: The other matter is that I have spoken to Professor
       Crawford.

  MR. JUSTICE BELL: Yes.

MS. STEEL: He has to go to give evidence in the USA to the Food
and Drug Administration. He would be able to come to court
to give evidence on 18th June. I am not sure how long
Mr. Rampton thinks he might take with cross-examination and
whether or not he might last -----

MR. JUSTICE BELL: He should allow more than one day. It may
not be necessary, but he should allow more than one day.

MS. STEEL: The thing is at the moment -----

MR. JUSTICE BELL: When is he out of the country?

MS. STEEL: I think he gets back the weekend before that. He
asked me not to call him on the Monday because he might
       have jet-lag.

MR. JUSTICE BELL: When does he go?

MS. STEEL: I think at the end of May. As far as I am aware, he
is available for all of that week, but the other scheduling
matters are that Danny Olive has said that he can come on
19th, that is the day after his exams finish, so we were
hoping to call him then. Jane Brophy says that she could
       come on 20th.

MR. MORRIS: At the moment -----

MR. JUSTICE BELL: Can Professor Crawford come on the week
       beginning Monday, 20th, 21st and 22nd?

MS. STEEL: I do not think he can; and also we do not really
want to call our witnesses before the Plaintiffs have given
their evidence. When I spoke to Professor Crawford, he was
extremely busy and this was virtually the only time that he
       could fit it in.

  MR. MORRIS:  We can reschedule Mr. Olive maybe to the Friday;
that will leave plenty of time for Mr. Crawford unless the
Plaintiffs might think he might take more than two days.

MR. JUSTICE BELL: Quite frankly, I think Professor Crawford is
more important than Mr. Olive in the overall scheme of
things. It is not to say you should not be able to call
them both, but Professor Crawford has to come back. I
would be very disinclined to think that Professor
