Day 245 - 07 May 96 - Page 09

MR. MORRIS: Yes, there are 3 Mcfact cards.

MR. JUSTICE BELL: They are at the back of 97.

MR. MORRIS: Have you got a packaging one?

MS. STEEL: We may have taken ours out. If there is not then
they are definitely in bundle 2.

MR. JUSTICE BELL: It has a number.

MR. MORRIS: It should be number 4. It is Mcfact card number
       5.

MS. STEEL: If it is not there then it is in bundle 2 of the
       original list of documents.

MR. JUSTICE BELL: Mr. Riley, can you take the chair and sit up
       where the bundles are, please?

MR. MORRIS: I think it is probably better to go to bundle 2
then in that case. It is definitely in bundle 2, tab 44.
If we keep the other bundle out because we will be
       referring to that one next.
       A. All right.

  Q. Sorry, it is number 44.

MR. JUSTICE BELL: There may be one in the corridor outside.

MR. MORRIS: Have you got in tab 44 a series of Mcfact cards and
one of them is called "recycling and fact number 5"?
       A. I have number 5. It is not totally legible; I am
       afraid.

  Q. No, it is not, especially the crucial bit. If you look at
the fifth paragraph, and this is dated 1990, this is a card
that was issued to all stores for customers to read; is
       that correct?
       A. Yes.

  Q. "We are currently running a pilot scheme in 4 restaurants
in the Nottingham area to assess the potential of recycling
foam containers. Customers are asked to divide the" --
I do not know what that says, effectively it is the
packaging anyway -- "waste, food remains and paper into one
bin and recyclable foam carton into another, the aim being
that the foam is then collected for recycling into such
things as plant pots, coat hangers, insulation material for
use in homes even fillings for duvets."

We have heard from Mr. Eddie Oakley, who is a Vice
President in charge of purchasing. He still in charge of
purchasing for Northern Europe, I believe?
  ?
       A. He is in charge of purchasing for the British Company,
yes, and he works for me in a couple of Northern European
       countries.
