Day 268 - 24 Jun 96 - Page 15

Q. Well, I put it to you that unless you were keeping a note
of every letter that you took and every letter that you
returned, there was no way, bearing in mind that on some
occasions you took several letters at one go and there were
several occasions when you took letters, there was no way
that you could be sure that all of the letters that you
took were returned?
A. The letters that I took were, in my eyes, of
significant importance and I would have returned them for
that reason so that they were not to be missed.

MR. MORRIS: In the whole time you were present in the group,
from 4th January until sometime in September, 10 months, I
did not participate in a single activity regarding
McDonald's, did I?
A. Unless it is mentioned in my notes, I cannot recall.

Q. Well, I am asking you, I did not, did I?

MR. JUSTICE BELL: Well, I will have to look at his evidence,
will I not? The trouble is if you ask a question like that
he can only give a reliable answer by going through
everything all over again. That is something you need to
put to me, pointing out where, if at all, you are mentioned
in the evidence or the notes. One would have to do an
analysis of them to have a reliable answer to it, quite
apart from any question of reliability of the evidence.

MR. MORRIS: I think, as we have seen, according to your notes
you attended 18 meetings and I only attended one of them,
effectively I was not involved with London Greenpeace in
the period when you were involved with the group?
A. If my notes say that I was there that many times and
you were, then that is correct.

MS. STEEL: Just one question. Page 3 of your third statement,
paragraph 7: "I did not attend the picket on the 6th of
January nor any other antiMcDonald's demonstrations or
pickets. I had no opportunity to distribute the leaflets
complained of or any other antiMcDonald's literature other
than on the one occasion described below." And in the next
paragraph there is reference to answering letter with Jane
Lapport. You would accept now that that paragraph in your
statement is incorrect, yes?
A. I will accept that. From recollection of looking at
my notes, it would appear that I did it on more than one
occasion. That particular occasion was with Jane
specifically.

MS. STEEL: No further questions.

MR. JUSTICE BELL: Thank you.

RE-EXAMINED BY MR. RAMPTON

Q. Only one thing, Mr. Claire, that I would like to ask you
about. Have you got the notes of 18th January in front of
you? It starts at page 16.
A. Yes, I do, sir.
