Day 270 - 28 Jun 96 - Page 16

MR. JUSTICE BELL: What sort of comment are you expecting?

MR. MORRIS: I am trying to be as non-leading as possible.

MR. JUSTICE BELL: She just said she did not think that she was
at the previous meeting. I do not want any comment from
the witness. I want evidence. She has affirmed what she
said in the first paragraph on that page.

MR. MORRIS: Then the next paragraph says:

"With reference to McDonald's, Dave said that the first
fayre had been an anti-McDonald's day. This was about 6
years ago and every year since then they had had an annual
       anti-McDonald's day."

MR. JUSTICE BELL: Would you just pause a moment. I assume, as
I said the other day when something similar was happening,
that when you read a note to a witness, if there is no
challenge to it from the witness, the witness is in effect
saying that that is an accurate record.

  MR. MORRIS: Right.

MR. JUSTICE BELL: If you just bear that in mind. To avoid any
doubt, it would be simple if you read something out and
just say "is that your best recollection" or "do you think
that is right". Then there is no doubt about it.

MR. MORRIS: Right. Just on this particular bit, I think it is
common ground that the fayre was only the previous couple
of years, not 6 years, and it is, like before, there is a
separate protest day and fayre, two separate days. Is what
you said about Helen the same, that you seem to have
       jumbled this up?
       A. It seems I might have done. I mean, I would have made
every attempt to record everything that was said with as
much accuracy as possible, but it may be that I
       misunderstood something that was said.

  Q. So that was the impression that you got?
       A. That was the impression that I got, yes.

  Q. It then says:

"John then explained this was now changing and the fayre
was to be a London Greenpeace fayre."
       A. Yes.

  Q. The next paragraph has got a list of workshops due to be at
the fayre. Would that be an accurate summary of the list
of workshops planned for that fayre?
       A. Yes, yes. I would assume that I put down everything
that I could remember that had been mentioned.

  Q. If there had been any discussion about McDonald's at that
fayre that was mentioned at that meeting, would you have
       made a note?
       A. I am sure I would have picked up on it, yes.
