Day 277 - 10 Jul 96 - Page 08

this or that date in these or those circumstances.
Because, I can easily draw inferences from the nature of
the press release or leaflets themselves that the
Plaintiffs intended, and indeed did get, some significant
degree of publication of them. And if that is, in effect,
common ground you have really got to ask yourself, indeed
if you applied for leave it is one of the questions I would
ask myself, is how far particular evidence of particular
incidents of publication take your case any further than
       you have got anyway.

MS. STEEL: Right. I suppose they have made an admission anyway
       so may be--

MR. JUSTICE BELL: Well, yes, at the moment it did not worry me
that it was inadmissible because I did not think it added
anything to what I would be able to infer in any event, but
       there we are.

  MS. STEEL: Right.

             Cross-examination by Mr. Morris, continued

  Q. One thing before I move on into the next area of
questioning, you mentioned in passing that there was a book
called 'The Death of Trees' in the London Greenpeace office
at some stage after you got involved with the group, but
before the service of the writs I think. We did serve this
last week and we never used it up until now. I do not know
where it was put. Do you remember, we served this
       document?

MR. JUSTICE BELL: Yes, I have it at the back of my notebook.
You will have to tell me sooner rather than later where you
       want to put it.

MR. MORRIS: We can put it in supplementary bundle 9. If I
remember supplementary bundle 9 -- or something -- might
be useful. I do not know what number yours goes up to now.

MS. STEEL: I have not actually got a copy up here so--

MR. MORRIS: If I can pass one to the witness.

MR. JUSTICE BELL: It is either 17 or 18.

MR. MORRIS: Which one would you prefer, 17?

MR. JUSTICE BELL: I will make it 17 for the moment.

MR. MORRIS: Is that the extract from the book which you recall?
       A. Yes.

  Q. Yes. This is a book by Nigel Dudley. I think, actually,
he came up earlier in the case when we had the evidence of
Theo Hopkins. I am not sure.
       A. I think the book is mentioned in some of the leaflets
that are in the counterclaim bundles as well, but I might
       be wrong there.
