  8. This license agreement is an agreement between the authors of the
  9. software 'The Next Tool' for Windows(R) 95, Christian Hagenah and Joerg
  10. Schliesser, and you, the user of the software. ('User' can be any
  11. individual person as well as a legal entity.) By using the software
  12. 'The Next Tool' for Windows(R) 95 or by distributing the software
  13. to a third person, you accept the terms of this license agreement.

  48. II. Grant of Usage
  49.  
  50. The software 'The Next Tool' for Windows(R) 95 is shareware. That
  51. means the software can be tried out for 30 days free of charge.
  52. If the software is to be used permanently, the user has to purchase
  53. a user license. By purchasing the user license, the user obtains a
  54. personal registration code as well as the right to use the software
  55. permanently.

  57. If an unregistered version of the software is used or the software
  58. is used without a registration code, a notification will appear about
  59. 10 days after the software was installed. After 30 days, the
  60. notification will block the use of the program and can be removed
  61. without quitting the program only after an increasing period of time.

  63. Distributing the unregistered version of the software is permitted,
  64. provided that none of the conditions that are named in this license
  65. agreement are violated.

  67. By purchasing a user license, the customer obtains the right to use
  68. the software without restrictions, according to the guidelines that
  69. are named in this license agreement. Purchasing a user license and
  70. a registration code only entitles the use of the software by one
  71. person on one computer system at one given moment in time. If the
  72. software is to be used on a number of computer systems at the same
  73. time, a user license and a registration code must be purchased for
  74. each installation of the software.
  75. The user license can be sold to a third person. In this case, the
  76. seller loses the right to use the software with the registration
  77. code that belongs to the license and the right to use the software
  78. becomes property of the buyer. The authors leave it to the seller
  79. and the buyer to inform them of the disposal of the user license,
  80. so a personal registration code, which belongs to the user license,
  81. can be generated for the buyer. Passing the registration code to a
  82. third person implies passing the user license.

  84. The software may be duplicated and distributed without the registration
  85. code according to the guidelines that are named below. Renting, lending
  86. or modifying the software as well as using the software on a number of
  87. computer systems with the same registration code at the same time is
  88. not permitted.
  89. Decompiling or disassembling the software is only permitted to obtain
  90. information that is necessary to establish the interoperability of a
  91. computer program that was created independently.

  95. III. Distribution Requirements

  97. The software 'The Next Tool' for Windows(R) 95 is protected by copyright
  98. laws and international copyright treaties. The software may be duplicated
  99. and distributed as an unregistered version, that means only without
  100. registration codes, according to the following guidelines and provided
  101. that none of the conditions of this license agreement are violated.

  103. - The software may only be distributed completely, inlcuding all files
  104. that are named below. None of the files may be modified or omitted.
  105.  
  106. - The distribution has to be free of charge or for a common
  107. contribution towards expenses.
  108.  
  109. - Including the software in public domain collections and the
  110. distribution on public domain or shareware CD-ROMs as well as
  111. spreading the software through computer networks and online
  112. services is allowed.

  114. - Selling the software commercially or distributing it as the sole
  115. program on a data carrier without written permission of the authors
  116. is not permitted.

  118. The authors reserve themselves the right to limit or revoke the right
  119. to distribute the software for individual persons without giving any
  120. reasons.

  189. V. Limited Warranty and Liability

  191. a) Disclaimer of Warranty for the Use of the Software Without
  192. Purchasing a User License and Without a Valid Registration Code
  193.  
  194. The user has the chance to try out the software for 30 days free
  195. of charge. The software is supplied as is. There is no warranty for
  196. the correctness of the software and its suitability for a certain
  197. purpose and the authors shall not be liable for any damages, direct
  198. of consequential, that arise from the free use of the software or
  199. the use of the software without purchasing a user license and
  200. without a valid registration code.

  203. b) Limited Warranty for the Use of the Software After the Purchase
  204. of a User License and the Use With a Valid Registration Code
  205.  
  206. The user has the chance to try out the software for 30 days free
  207. of charge. The purchase of a user license takes place for the software
  208. 'as is' during the test period. No claim may arise from the purchase
  209. of a user license for the removal of defects that are obvious and/or
  210. already known to the user before the purchase of the user license.

  212. The authors guarantee that the software 'The Next Tool' for
  213. Windows(R) 95 corresponds to the product description and the
  214. documentation in all essential points and shows no errors or
  215. defects that limit the usability of the software regarding the
  216. usage as it was possible and known to the user before the
  217. purchase of the license, during the free test phase.
  218.  
  219. In the case of a complaint, the licensee is commited to send his
  220. registration code and a comprehensible and verifiable description
  221. of the defect to the authors, so the defect can be examined and,
  222. if possible, removed and the software can be repaired. The costs
  223. for the examination and the removal of the defect will be covered
  224. by the authors if the complaint proves to be justified.

  226. There is no warranty for defects or damages that arise from a
  227. modification of the software by a third person, from a use of the
  228. software that does not correspond to the functionality as it is
  229. described in the online help or from the non-observance of notes
  230. in the documentation. In these cases, the authors shall especially
  231. not be liable for side-effects or damaging after-effects of a defect.

  233. If a repair or the delivery of a replacment does not remove an
  234. essential defect within a reasonable period of time, the licensee
  235. has the right to step back from the agreement or to demand a reduction
  236. of the license fee. Further claims by the licensee are excluded.

  239. c) Limited Liability
  240.  
  241. The authors shall only be liable for damages of the licensee as far as
  242. they arise from intentional actions or gross negligence or from the
  243. violation of an essential duty by the authors or as far as they have
  244. to be compensated according to applicable law.

  246. In any case, the liability of the authors shall be limited to those
  247. typical damages the occurrence of which the authors have to sensibly
  248. expect according to the circumstances that are known to the authors
  249. at the moment of the completion of the contract.
  250.  
  251. This limitation of liability is valid for all claims of compensation,
  252. regardless of the cause in law, especially for liability that arises
  253. from illegal action or guilt during contractual negotiations. The
  254. limitation of liability does not cover damages for which an imperative
  255. legal liability exists. For other damaging after-effects of a defect,
  256. the authors shall only be liable in the limited way described above.

  260. VI. General
  261.  
  262. This agreement is subject to German law. The 'Convention on Contracts
  263. for the International Sale of Goods' is excluded. The exclusive place
  264. of jurisdiction is Stuttgart (Germany) for all disputes that may arise
  265. from this license agreement or from the use of the software. However,
  266. the authors remain authorized to take legal actions against the
  267. licensee at his general place of jurisdiction.

  269. If some parts of this license agreement are or become partly or
  270. entirely invalid or incomplete according to applicable law, the
  271. validity of the remaining parts of the agreement is not impaired.

  273. The transferal of rights from this license agreement by the licensee
  274. is excluded.
