Day 177 - 26 Oct 95 - Page 13

may just treat him as a Civil Evidence Act notice.
Dan Gallin, we are still waiting for him to get back to us.

MR. JUSTICE BELL: So he has a question mark.

MR. MORRIS: Yes -- as far as the Civil Evidence Act or not.
I think it would actually be quite helpful to take
       Mr. Rampton's proposed course.

MR. JUSTICE BELL: Let us start from the end. I can see a
variety of advantages in Mr. Chester giving evidence in the
new year. It enables us to carry on with employment; it
gives everyone an opportunity to read back into the
environment side of the case during the vacation. I am
moved by his family situation. So, unless you or Ms. Steel
wanted to say anything, I think I will vacate Mr. Chester
before Christmas and talk about him again. Do you want to
       say anything about that?

  MS. STEEL: No.

MR. JUSTICE BELL: So far as Mr. Logan is concerned, I think it
is important that the parties be as ready as they are
likely to be to go with the documentation when Mr. Logan
       comes into the witness box.

What occurs to me might serve everyone best is if the
bundles of new documents can be delivered at or towards the
beginning of the week beginning Monday, 6th November, if we
       take Mr. Logan ---

MR. MORRIS: I think we are talking -- no. Yes, I see. Sorry.

MR. JUSTICE BELL: -- which is the week after next; we take
Mr. Logan out of Thursday the 9th and 10th; and, as it is a
matter of some considerable importance to your case -- and
Miss Steel's, through you, Mr. Morris -- you would be very
well advised to get Mr. Logan to come to London anyway ---

MR. MORRIS: Or we go there.

MR. JUSTICE BELL: -- or you go there, and actually go through
the documents with him in one or both of the two days when
he would otherwise be in court.

MR. MORRIS: That would be a very good idea.

MR. JUSTICE BELL: I will take him out of that day as well.

MR. MORRIS: Can I just say that the Plaintiffs were offering to
provide them by the beginning of next week or by the middle
       of next week.

MR. JUSTICE BELL: It does not matter, because I have heard what
Mr. Rampton has to say. There are clearly a lot of
documents. Provided you have those two days to use on
       documentation -----

MR. MORRIS: The earlier we have them the better, that is all.
