Day 185 - 07 Nov 95 - Page 20
MR. JUSTICE BELL: That is a comment. It is not a question.
That is what you ought to be saying to me if that is your
case because there is no point in asking Miss Iurilla about
that.

MR. MORRIS: OK.

MR. JUSTICE BELL: You know the way you have pleaded your case
in relation to Orangeville. The whole of the evidence
about unions is with a view to justifying the statement in
the leaflet, that it is McDonald's policy to get rid of
people involved with unions. I have not got the exact
words.

MR. MORRIS: It is about how it is difficult to form a union.

MR. JUSTICE BELL: Yes, but it is more ---

MR. MORRIS: All that stuff.

MR. JUSTICE BELL: -- "McDonald's have a policy of preventing
unionisation by getting rid of pro-union workers. So far
this has succeeded everywhere in the world, except Sweden
and Dublin after a long struggle". When you are
cross-examining witnesses in relation to that, that issue,
remember that that is the main point you want to ask me to
infer that, I would find that has actually happened or to
infer that is their policy from events around the world.
But when we are going into things like Orangeville,
Ontario, obviously, you have to go into a certain amount of
detail, but remember that is what you are aiming at at the
end of the day.

MR. MORRIS: I understand. There are some questions asked which
are absolutely central to it, because it is clear to me,
and this is just argument -----

MR. JUSTICE BELL: It would be a comment, you see. I do not
think this witness can answer them.

MR. MORRIS: No, OK.

MR. JUSTICE BELL: I thought your point, basically, was that she
did not know what was going on. Someone else instructed
the lawyers, someone else paid them, and I thought you were
going to suggest that Miss Iurilla did not know who that
was because it was being organised by either Ballantyne or
McDonald's in Canada. If that is so, I thought your point
was that she did not know what was going on, that she was
being used. If that is your case, there is not much point
about asking her what she did not know was going on.

MS. STEEL: You mentioned Bonnie McLellan just a little while
ago. You said that she had decided to make McDonald's her
career. How old was she?
A. She is, I do not know, I would say she is 24, 25.

Q. Right. She was not just regular crew, was she?
A. She is a maintenance person, so she is crew but she
does the cleaning in the restaurant. She sometimes works
