1 that Mr. Shafibeik is sure about the dates of the first
2 time that he worked there. But he is not; he is not sure
3 about any of the dates. I think it would be helpful if, in
4 the same way that the Plaintiffs gave us a printout of when
5 they thought Mr. Jackson had worked at the store, if they
6 could provide one for Mr. Shafibeik, or if they know now.

10 MR. MORRIS: Can we ask the Plaintiffs now if they do know the
11 dates?

13 MR. RAMPTON: I am afraid we do not. It is difficult, if people
14 do not become Managers, to find out when they worked as
15 crew, particularly as it is as long ago as 10 years. The
16 reason why I asked the question about the first period was
17 that Mr. Shafibeik says in his own statement that at the
18 time of McDonald's Freedom Fighters, Mr. Davis was
19 Manager. That helps us to think that Mr. Shafibeik's first
20 period is accurately dated in his statement, because
21 Mr. Davis was First Assistant.

25 MR. RAMPTON: Right at the bottom, in the last paragraph.

29 MR. RAMPTON: Yes, Assistant. He did not become Manager until
30 1st November 1984, which makes one think that the dates
31 given for the first period in the statement are likely to
32 be something like right.

34 MR. JUSTICE BELL: That may be so, but it happened at a period,
35 according to Mr. Shafibeik's evidence, when Mark Davis is
36 Assistant Manager, because it was Mark Davis who warned
37 him.

41 MR. JUSTICE BELL: The dates which he gives, having said that he
42 is not sure about the dates for his first period, between
43 July and September 1984, are when Mark Davis was First
44 Assistant, and the July 1984 is the time when Mr. Coton
45 actually joined. He joined that month.

47 MR. RAMPTON: That is right; and, of course, what Mr. Shafibeik
48 has given as the timing of the McDonald's Freedom Fighters
49 incident accords with what Mr. Coton told your Lordship in
50 evidence.

56 MS. STEEL: I do not actually know the answer to this question,
57 but I just wanted to clarify something. When you say that
58 Mark Davis was the Assistant Manager, do you know for sure
59 that that was the case or is that what you think you
60 remember?
