Day 268 - 24 Jun 96 - Page 12
MR. JUSTICE BELL: Carry on with your cross-examination. It is
not helpful to me, and, after all, I am going to judge the
case at the end of the day, so I know what I will find
helpful and what I will not, is whether he thinks it is
right to go into the Caledonian Road offices by slipping
the lock but not right to go into someone's house. It just
does not help me at the end of the day.

MS. STEEL: No, but I was trying to get at the rationale of
saying he could do one but not the other.

MR. JUSTICE BELL: Please observe the ruling and carry on.

MS. STEEL: Well, are you quite sure that you never slipped the
lock and got into anybody's house during the course of this
investigation?
A. Completely sure.

Q. If you look at the notes for 6th September 1990, page 54 of
the notebook.

MR. RAMPTON: Again there has been an error. Your Lordship has
not got that. It is the last one in the book, I think.

MR. JUSTICE BELL: If either side wishes to rely upon the notes
of 12th July or 6th September, the person who wants to rely
on them, and it may be both sides, must make sure I have
copies.

MR. RAMPTON: An administrative error.

MR. JUSTICE BELL: And I will then insert them in my notes.

MS. STEEL: "Just popped in to show my face." Sorry, this is 6th
September, 5 Caledonian Road. "Just popped in to show my
face. Jane only in the office. She was going through
letters etc. Just said hello and asked what is happening
lately. Not a lot was, especially on the McD side of
things." So you would have asked her about what was
happening on the McDonald's side of things?
A. Perhaps it was mentioned in a discussion, yes.

Q. "Reminded her that I would do videos at the fair. Left at
7.30, arrived at 6.30." So you were letting her know that
you were still keen to help with the organizational aspects
of the fair?
A. It must have been mentioned at that time and I would
have said yes, that I was still doing them.

Q. Well, you say you reminded her, so you must have brought it
up?
A. It reads that way, yes, it does.

Q. And you were there for an hour. You would have helped
answering letters during that time presumably, rather than
sitting there doing nothing?
A. I cannot recall. Perhaps, I would. I cannot recall.

Q. Is that the last note in your book?
A. Yes, it is.
